Trans fat ban made fast food a bit healthier in NY

WASHINGTON (AP) ? Turns out it's possible to make a fast-food lunch a bit healthier even without skipping the fries.

New York City now has hard evidence that its ban on trans fat in restaurant food made a meaningful dent in people's consumption of the artery clogger and wasn't just replaced with another bad fat.

The findings being published Tuesday have implications beyond heart health, suggesting another strategy to curb the nation's obesity epidemic fueled by a high-calorie, super-sized environment.

Consider: Americans get more than a third of their daily calories from foods prepared outside the home. By year's end, the Food and Drug Administration hopes to finalize long-awaited rules that would make many restaurant chains post the calorie counts of their products right on the menu. Maybe the guilt would make you forego the french fries for a salad. Maybe not.

Now contrast New York's trans-fat ban ? later copied by more than a dozen other state and local governments ? which didn't put all the onus on the consumer to do the right thing.

"By making the default option the healthier choice," everyone benefits regardless of their nutrition awareness or willpower, Alice Lichtenstein, a nutrition specialist at Tufts University, wrote in a commentary on the research. "The regulation may serve as a model for future successful public health initiatives."

There are good fats and bad fats. Trans fat is widely considered the worst kind for your heart, gram-for-gram more harmful than its better known cousin, saturated fat. Small amounts occur naturally in some meat and dairy products. But much of the trans fat we eat is artificially produced, by hardening liquid oils so they can be used for baking or a longer shelf life.

In 2006, the federal government began requiring that packaged foods list the amount of trans fat contained per serving, a boon for grocery shoppers who could finally tell which processed foods were more or less heart-healthy.

But restaurant fare remained a mystery. So New York City issued a first-of-its-kind rule restricting artificial trans fat in restaurants, forcing them to alter recipes so that foods contained no more than 0.5 grams per serving. The change affected customers beyond New York as big chains like McDonald's wound up cutting the fat system-wide.

The latest study by the New York City Department of Health and Mental Hygiene shows the effect. Researchers surveyed customers and collected receipts for nearly 15,000 lunchtime purchases at fast-food chains around the city in 2007 and 2009, before and after the ban was in place.

The amount of trans fat in each lunch sold dropped an average of 2.4 grams after the ban, researchers report in Tuesday's edition of Annals of Internal Medicine. The biggest drop, 3.8 grams, occurred in hamburger chains, followed by Mexican food and fried chicken chains.

No one's saying that turned junk food into health food. But for people who eat fast food regularly, it's a significant reduction in heart risk, said Margo Wootan, director of nutrition policy at the advocacy group Center for Science in the Public Interest.

The American Heart Association has long recommended that people limit trans fat to less than 2 grams a day. The newest government dietary guidelines urge people to eat as little trans fat as possible.

Moreover, the study also suggests that restaurants didn't just swap out one bad ingredient for another as some nutritionists had feared. It found only a small increase in saturated fat, mostly in sandwich chains. That's at least partly due to those customers buying meals with a lot more calories in 2009 than before, said study co-author Christine Curtis. That time period saw Subway's introduction of $5 foot-long subs.

Overall, Americans' trans fat consumption has dropped by more than half over the last decade, thanks to the combination of nationwide food-labeling and community restaurant restrictions, according to an update published in the Journal of the American Medical Association this month.

Still, 10 percent of children and adults consume more than 2.6 grams of industrially produced trans fats a day ? not counting the natural type, said that review by researchers at the Centers for Disease Control and Prevention. Those people tend to consume certain brands of frozen pizza, frozen desserts, microwave popcorn and chips that still pack in the trans fat.

The trans-fat evolution shows that "no one policy is going to be the cure-all" for nutrition ills, said CSPI's Wootan.

She points to the upcoming menu calorie counts. New York City already requires calories to be posted on menus, and a study found only 15 percent of diners ordered healthier foods. But those who did cut 100 calories per meal, which adds up fast, Wootan noted.

And peer pressure should make restaurants revamp recipes to cut calories, just like posting trans fat on grocery food labels pushed manufacturers to improve those offerings, she added.

Stay tuned on the calorie front: The FDA's menu-labeling rules were expected months ago. There's been a lobbying fight over whether they should include how many calories are in alcoholic drinks or in foods sold in places like movie theaters, where a tub of popcorn can total half your day's allotment.

But Wootan would like to see additional options that make the lower-calorie choice the default. Why shouldn't the fast-food meal-deal come with fruit, so you have to order the fries separately if you really want them?

"Right now the automatic choice, the easy choice, is the unhealthy option. If it were turned around, many more people would eat healthfully," she said.

Jason Kidd Arrested For DUI

NBA All-Star Jason Kidd was arrested this morning for DUI this morning in New York State, reportedly for crashing into a telephone pole in the Hamptons.

Kidd was the lone passenger in the accident, which officials say happened around 2:00 a.m. Police described the basketball star as "being intoxicated."

The crash occurred near Kidd's summer home on Long Island.

The future Hall of Fame member was taken to a local hospital to treat minor injuries but luckily was generally unharmed after the single-car crash.

After being released from the hospital, he was transported directly to a local police station for processing and booked for driving under the influence.

Cops say that Kidd was arraigned on a misdemeanor DUI charge in Southampton Town Justice Court and then released on his own recognizance.

Jason Kidd, 39, won an NBA title with the Dallas Mavericks in 2011; he signed a three-year, $9.5 million deal with the New York Knicks on July 5.

Baseball great pleads guilty to bankruptcy fraud

LOS ANGELES?Former All-Star outfielder Lenny Dykstra pleaded guilty Friday and could face 20 years in prison for hiding and selling sports memorabilia and other items that were supposed to be part of his bankruptcy filing.

Dykstra, 49, entered his plea in U.S. District Court to one count each of bankruptcy fraud, concealment of assets and money laundering.

It was the latest legal problem for Dykstra, who earned the nickname "Nails" because of his gritty style of play, and spent his 12-year career with the New York Mets and Philadelphia Phillies. He previously pleaded no contest to grand theft auto and exposing himself to women he met through Craigslist.

Dykstra, who bought a mansion once owned by hockey star Wayne Gretzky, filed for bankruptcy three years ago, claiming he owed more than $31 million and had only $50,000 in assets.

After the filing, Dykstra hid, sold or destroyed more than $400,000 worth of items without permission of a bankruptcy trustee, prosecutors said.

"Mr. Dykstra's days of playing games with the public and the legal system are over," said U.S. Attorney Andre Birotte Jr. "These convictions should serve as a cautionary tale of a high-flying sports celebrity who tried to manipulate and exploit both his creditors and the bankruptcy laws."

Court documents show Dykstra said he put an oven, sconces and chandeliers into a storage unit, but prosecutors said he actually sold the items for $8,500.

He also hid baseball gloves, balls, bats and other memorabilia from the bankruptcy court and creditors and sold them last year for about $15,000, court documents show.

Asked by U.S. District Judge Dean Pregerson if he had committed the crimes involved in the guilty plea, Dykstra responded, "Yes, your honor."

Dykstra, wearing a jail-issued green jacket and white jumpsuit, entered the courtroom shackled in handcuffs. The stocky, gray-haired defendant conferred briefly with his defense attorneys before the hearing and was led away by U.S. marshals.

Dykstra was indicted in February on 15 counts. Prosecutors said he agreed to waive his right to appeal if he's sentenced to less than 51 months in prison. Dykstra also could face fines up to $750,000.

He is currently serving a three-year prison sentence after pleading no contest to grand theft auto and providing a false financial statement. In that case, Dykstra was arrested last year by police who said they found cocaine, Ecstasy and synthetic human growth hormone at his Los Angeles home last. In exchange for his plea, prosecutors dropped 21 counts against him.

He also was sentenced this year to nine months in jail after pleading no contest to charges he exposed himself to women he met through Craigslist.

BOCC OKs future Polk State College criminal justice school

Approval was granted by Polk County Commissioners at their July 10 regular meeting for the creation of a police academy that will be located on the campus of the Polk County Sheriff?s Office Operations Center near Winter Haven.

In an interlocal agreement, a total of 10 acres has been authorized by the Board of County Commissioners to be sold to Polk State College for $1. In addition to the police academy, other courses in public safety, such as emergency management services, will also be taught at the new facility.

Upon completion, the facility will have a total of 100,000 square feet, 10 times larger than the site, where classes are now being taught at another campus, also located in Winter Haven.

According to Linda McKinley, deputy county attorney, this was first broached by Sheriff Grady Judd in 2009. However, it was not until this year that the Florida Legislature approved $9.25 million toward the venture.

?This is the latest in a number of very successful partnerships with the sheriff,? McKinley said.

However, that initial funding only covers one-third the estimated cost, which is projected at $30 million, according to Peter Elliott, vice president of administration for PSC.

Response by commissioners following a PowerPoint presentation by Elliot was positive.

?When?s the groundbreaking?? asked Commissioner Todd Dantzler. That was yet to be determined was Elliott?s reply. In addition to raising additional funds, more groundwork needs to be done, including having an architect and engineer design the proposed facility, as well as hiring a contractor. The plans are necessary, said Elliott, to demonstrate to the Legislature that progress is being made, as PSC intends to petition for more funding during the 2012-2013 legislative session.

Elliott later noted that PSC would be applying for a bachelor?s degree in criminal sciences once the facility is up and running.

?How many students do you expect? Are there other facilities in the state?? asked Commissioner Bob English. Taking the second question first, Elliott told English that although he did not have that information with him, there currently are several; he knew of one in Broward County.

As to the number of students, Elliott stated ultimate enrollment had not yet been determined.

?Will we be attracting students from out of the county?? English then asked.

?Absolutely,? said Elliott.

What the current space would be used for was of interest to Commissioner Edwin V. Smith. That space will be refurbished and used for other classrooms, Elliott said.
