U.S. approves California bullet train construction

The Obama administration Wednesday gave the first formal regulatory approval to the California High-Speed Rail Authority's plan to construct a bullet train between Los Angeles and San Francisco, clearing a major legal hurdle to starting the project in the Central Valley.

The action allows the rail authority to begin acquiring the first of nearly 1,000 parcels of land that will be needed between Merced and Bakersfield to construct about 130 miles of rail by 2017, rail officials said. The deadline is a requirement of federal stimulus funding that the state has received.

"It is a very big step and a very important milestone," said Jeff Morales, chief executive of the rail authority. "It allows us to move forward in earnest."

But the decision contains a list of costly requirements, including habitat mitigation for several endangered species and abatement of diesel emissions that will occur in the Central Valley during construction. Even with the decision, the rail authority will need permits from the Army Corps of Engineers and the San Joaquin Valley Air Pollution Control District before it puts a shovel into the ground. Those approvals would normally take six months or more, but Morales said the state is working to expedite the procedure.

The federal approvals already appear to have taken significantly longer than expected. The rail authority had said last year and earlier this year in public statements that it expected the approval to occur in June and that it hoped to begin construction before the end of this year.

Now the authority is hoping to start construction in spring 2013. The task of completing about $6 billion of work by the 2017 funding deadline would require spending $2.7 million to $3.5 million per day. Construction industry officials say that would be an aggressive plan and that every day of delay makes the job harder.

Morales said the project remains on schedule and the extra time needed to obtain the federal approval was normal for such a large-scale and complex project.

"There was paperwork going back and forth," he said. "One depends on another. You think you have reached the finish line and then you have farther to go."

The 41-page approval, known formally as a record of decision by the Federal Railroad Administration, covers the section of track from Merced to Fresno, an area where agriculture interests are staunchly opposed.

The Madera Farm Bureau, along with other groups, has filed an environmental lawsuit and is seeking a preliminary injunction to stop the project. In legal filings, it contends that the authority is harassing land owners.

Anja Raudabaugh, the farm bureau's executive director, said the rail authority will have trouble buying land in her area of the Central Valley.

"Not a single one of those landowners will be a willing seller," she said.

Morales said condemnation will be a last resort. "Every effort will be made to reach a fair and equitable settlement," he said.

Quentin Kopp, a former chairman of the rail authority and a retired judge, said despite the federal decision, "it is apparent that there are substantial legal problems" facing the project.

We?ve been hard at work the hubby and I. We?ve managed miraculously somehow to move to our new house with two kids (a big thank you to our mom?s for watching the girls). You don?t realize how much you?ve accumulated over the years until you need to move ? especially when you soon realize that both you and your spouse might be pack rats.

Alas, a picture of our new house . . . isn?t it pretty? We think so =) Sorry for the sun flare ? between everything going on, I didn?t have time to properly set up for exposure or have a lens hood (photography speak).

After over two years of searching and 100 days worth of waiting to close, we finally have a ?real house?! Its a four bedroom, three and a half bathrooms on a little less than an acre lot. What really sold on on the house were the front and back views of the house. There is a walking trail in front, which means no neighbors in front; there are trees in back that hide the neighbors behind us that are apart of another subdivision. Don?t get me wrong, I like having neighbors ? but I also like my privacy and having views of something other than another house.

Inside the house, here are the things I love:

Hardwood floors on the first floor
The hearth room
My pantry
The girls having a ?hollywood? bathroom
A huge unfinished basement (lots of potential)
Master bathroom has TWO shower heads

We also just found out that the house next to us that was for sale also sold! The current neighbors told us that they sold it to a younger couple like us who was expecting their first child. And he said the neighbor next to him has a young child that may be of babysitting age! How exciting!

As mentioned in this post, this house was a short sale. Which meant that it was just a few steps above being a foreclosure. The sellers built the house, then the housing market took a dump, and the house was no longer worth the value of what they still owed on the mortgage. So, the sellers had to (a) cough up the difference or (b) see if the bank who held held the mortgage would eat the cost ? the short sale.

When we initially saw the property online, it was fully furnished. Well, when our realtor showed it to us, it was vacant. We later found out that the sellers filed bankruptcy and moved out of state. When they moved out of the house, let?s just say they weren?t very careful when moving their furniture out. That?s one thing that?s similar with respect to foreclosures and short sales ? the sellers can?t afford their home, so they have no need to keep it ?maintained? in good condition. I mean, it wasn?t in too terrible compared to the foreclosures that the hubs and I have looked at. Our house just needs some putty work on the drywall and new paint ? everywhere.

Here are our top three projects thus far:

Yard/Grass. The grass needs a lot of work. Lots of brown spots everywhere. It doesn?t help that the current neighbors are retired and pretty much work on their yard every day of the week literally. We?re getting quotes right now to get some lawn service guys to do it this first year ? and this was something hard for Ryan to swallow. I somehow managed to convince him that its ?okay? to hire someone to do work and that you don?t have to DIY ? especially when hunting season is around the corner =) (Guess which part of that made him consider hiring someone was okay).

Walls. The sellers were the originally owners, so they picked everything out on the house. Their wall color choice just made the house seem really really dark. The trim around the house is a khaki color, but they chose this cream color for the drywall that darkened the room. So we are planning on painting the whole house.

We got quotes to see how much it would cost to paint just the ?public? areas. The quotes were between $1500 ? $2500. Um, no thank you. We?ll just do it ourselves or get our friends to help for a case of beer. A big thank you again goes out to Ryan?s momma for painting Ansley?s room (pictures to come later).

There were also huge holes that we need to patch around the house. I don?t know if someone got mad with a hammer, but these were pretty good dents on the dry wall.

Also, I?m assuming that their realtor probably told them to touch up the paint in the house. The reason why I say this is because there are patches of paint on the trim and the wall that look the same ?shade? but isn?t quite a match. We then found some paint cans downstairs for the house colors ? and I?m thinking that the paint aged or they didn?t shake it well enough. In the living room, if you look up, you can see how there are two tones to the paint. Obviously, I?m adding that to the ever growing honey do list.

Hardwood Floors. When the sellers were dragging their stuff out, they didn?t take care to not scratch the floors. They didn?t leave us a fridge, but they did leave us floor marks showing us where they slid the fridge out. The scratches were pretty bad. We decided that if we had to do one thing before we move it, it would be the hardwood floors. This was not a DIY project ? so I had to find a contractor.

I spent $28 for an annual membership on Angie?s List. That was the best $28 bucks that I?ve spent. At first, I was skeptical to see if it was really real reviews. Oh ? yes they were. People were quite honest about their good and their bad experiences.

That?s where I found Fish Flooring. Shad is the owner of Fish Flooring and at the time had 23 reviews ? and they were all A?s. I had him and another competitor come out to quote (this competitor was a recommendation from a friend). They both were very knowledgeable and gave me a quote within 24 hours.

A few hours after sending me the quote, I decided to look up the competitor ? and he had some As, but also D?s and F?s. Whoa. So I was a little hesitant on him.

Then I saw that on Angie?s list, Fish Flooring (Shad) had a 10% discount for Angie?s List. So, I was sold on Fish Flooring!

I told his competitor we decided to go with someone else, and the competitor tried to say stuff like, ?I don?t know how long the other guy has been in business ? what type of material is he using ??. That kind of pissed me off, so I said, ?Look guy. Fish Flooring had rave reviews on Angie?s List and you didn?t. At the end of the day, material probably does matter, but as a consumer, if he did a good job for everyone else, and the end result looks good to me, I really could give a rat about the material he uses. Additionally, Shad never said one bad thing about his competitors ? and that?s honestly why I chose him.? The competitor then tried to explain all the 5 bad reviews?

Anyway, Shad came out the next week to finish the job in three days.

This is a picture of what the floor looked like before. Where you see the three different colors were where Shad had sanded the floor down to the natural wood, and put stains there for me to pick from:

Here is the after photo ? no more scratches ? yeah!

Basically, the process is that they first sand down the floors and remove the current gloss and stain. I then got to choose my own stain color. Then they re-patched, stained, then put two coats of poly on.

What was really cool was that when they sanded down to the wood, the wood was natural color and very light ? which lightened up the entire room. Shad told me light/natural wood is great but if you choose to go that way, it shows more of the imperfections in the wood. We decided to go with a darker stain with a little red in it.

One project down, fifty more to go =) Next up, appliance purchasing and Ansley?s room! Stay tuned.

New Zealand's Whanganui River Gains A Legal Voice

If corporations are people now, why can?t rivers be?

Under a landmark agreement, signed in New Zealand earlier this summer, the Whanganui River has become a legal entity with a legal voice.

The agreement is the result of over a hundred years of advocacy by the Whanganui iwi, an indigenous community with a long history of reliance on the river and its bountiful natural resources.

The Whanganui, the third longest river in New Zealand, will be recognized as a person under the law ?in the same way a company is, which will give it rights and interests,? Christopher Finlayson, a spokesperson for the Minister of Treaty Negotiations, told the New Zealand Herald.

Organizations that work to protect the rights of indigenous communities worldwide are celebrating the agreement as an affirmation of the inextricable relationship between indigenous communities and natural ecosystems.

?The recognition of the personhood of the Whanganui River represents a landmark moment in legal history,? Suzanne Benally, the Executive Director of Cultural Survival, wrote in an email to TakePart. ?Nature cannot be seen solely as a resource to be owned, exploited and profited from; it is a living and sustaining force that needs to be honored, respected, and protected by all of us.?

Treehugger points out that this isn?t the first time the natural world has received monumental rights?or a good lawyer.

In 2008, Ecuador became the first nation in the world to recognize the legal rights of its mountains, rivers, and land.

Frustrated by the exploitation of the Amazon and the Andes by multinational mining and oil corporations, delegates in Ecuador turned to the Pennsylvania-based Community Environmental Legal Defense Fund to help rewrite the country?s constitution.

The delegates wanted to provide legal protection for Ecuador?s environment and its resources. The Legal Defense Fund helped them include a ?Rights of Nature? framework in their constitution that allows people to sue on behalf of an ecosystem.

In 2011, the new law got its first test. A suit was brought on against the Provincial Government of Loja, on behalf of the Vilcabama River in Ecuador.

The local Loja government had allowed a road that abutted the river to be widened, which forced rocks and debris into the watershed and caused large floods that affected communities living on its banks.

As a result of the ?rights of nature? provisions in Ecuador?s constitution, the judge decided in favor of the river. The municipality of Loja was forced to halt the project and rehabilitate the area.

Ecuador?s new constitution has been an inspiration to communities and governments all over the world who want greater protections for their local resources.

?People not only in the U.S. but also in other countries are saying to themselves that something is fundamentally wrong with our environmental legal frameworks,? says Mari Margil, associate director of the Community Environmental Legal Defense Fund.

?Temperatures are rising, fisheries are disappearing, and forests are being cutt down. We need to move to a different kind of environmental protection. Our current environmental laws are all about how much we can use or exploit nature,? she told TakePart.

Margil?s organization has worked with communities in New Hampshire, Virginia, and Pennsylvania to shift their thinking about how they can preserve and sustain their natural resources. Earlier this year, Margil and her colleagues helped launch the first ?rights of nature? organization in Italy.

The Clean Water Act, the Clean Air Act, and other current environmental laws actually legalize environmental harm by regulating how much pollution and degradation to an ecosystem is lawful, Margil says. Under existing law, nature is considered to be property.

The Legal Defense Fund is at the center of a movement that believes climate change and other growing international issues require new ways of thinking. ?Ecosystems and natural communities are not merely property that can be owned,? according to the organizaton?s website, ?but are entities that have an independent right to flourish.?

Confirmed, wife is seeing another guy.? As of right now she filed a restraining order shorty after she filed for divorce.? Things that were said in there aren't fair at all as she has done all the same stuff.? Stuff listed in the restraining order was stuff from long long ago, what would be the reason of her filing that now all of the sudden?? Well her with another guy is one of them and because she wants the house.? I am having a tough time trying to figure out what God wants me to do with this.? Right now I am paying for the entire house, living at moms.? She is, well, using me.? I am not mad at her for this as she is in sin.? I have been fighting to reconcile my marriage and I was going to let her have the house, till I found the truth.? Now I dont know what God wants me to do.? I have an attorney, christian one as a matter of fact who fights for my rights in divorce but also fight for reconciliation.? I am trying to figure out now, do I give up on my marriage and reconcilation and just give her the house and walk away?? Do I fight for reconciliation still, praying freverently to God that he will intervene and speak to her heart and get her to see what she has done?? Or do I fight for the house and get her out of it so that it makes it hard on her and her new boyfriend?? I am not sure what God would have me do. I have prayed and prayed and have really tried hard to do this God's way every step of the way, but with this new information, I am stuck and am not sure what God is saying to me.

Sandusky to be sentenced Oct. 9 in sex abuse case

BELLEFONTE, Pa. (AP) ? A judge announced Monday he will sentence Jerry Sandusky on Oct. 9, nearly four months after the retired assistant football coach was convicted in the child molestation scandal that brought shame to Penn State.

Sandusky was convicted in June of 45 counts of sex abuse involving 10 boys. Prosecutors said some of the assaults took place on the Penn State campus.

Given his age and the serious nature of the crimes of which he was convicted, Sandusky is likely to receive a sentence that will keep the 68-year-old in prison for life. He is jailed pending sentencing and maintains his innocence.

Judge John Cleland scheduled a hearing for 9 a.m. at the courthouse in Bellefonte to determine if Sandusky should be classified as a sexually violent predator, a designation that subjects a convict to intense reporting requirements upon release. An assessment board has recommended Sandusky for the designation, though it's expected to have little practical effect since he stands to die in prison.

Sandusky will be sentenced immediately afterward. Cleland ordered defense attorneys and prosecutors to submit written statements "intended to aid the court in the imposition of sentence" by Oct. 5.

The abuse scandal rocked Penn State, bringing down famed coach Joe Paterno and the university's president and leading the NCAA to levy unprecedented sanctions against the football program.

Former FBI Director Louis Freeh, hired by school trustees to conduct an investigation into the university's handling of abuse complaints against Sandusky, concluded that Paterno, ousted President Graham Spanier and two other high-level school officials concealed a 2001 allegation against Sandusky to protect Penn State from bad publicity.

The late coach's family and Spanier hotly disputed Freeh's conclusions. So did former athletic director Tim Curley and retired vice president Gary Schulz, who have been charged criminally with failure to report suspected child abuse and perjury. They have pleaded innocent and await trial.

Some alumni groups have also attacked the Freeh report and said Penn State and the NCAA should not have accepted its conclusions.

Republican vice presidential candidate Paul Ryan is speaking in Pinellas County later this morning.

Ryan, Mitt Romney's running mate, will be in Oldsmar at R.E. Olds Park. He is scheduled to speak just before noon.

R.E. Park is located in a residential neighborhood at the edge of Old Tampa Bay. The public is asked to park at Tampa Bay Downs, located at 11225 Racetrack Road in Tampa. A shuttle service will run from the racetrack from 7:30 a.m. on, and event grounds will open at 8 a.m. The rally will begin at 11 a.m.

With certain exceptions, talk of advanced hard drive technology regularly has a tough time escaping research labs. Western Digital's HGST is promising a much more tangible project that could boost data capacities by a wide margin. By filling the gaps between drive platters with less buffeting-prone helium instead of air, HGST can safely fit as many as seven platters in a typical, 3.5-inch desktop hard drive instead of the current five. Going with the lower density gas creates a raft of side benefits, such as fitting more data on a single platter along with reducing the drag that both slows down and heats up the disk. We'll have to wait until 2013 to see shipping helium-filled drives in our PCs; given the slightly exotic nature of the technique, though, we wouldn't count on HGST or Western Digital handing out drives for free like balloons at a birthday party.

The replacement refs know that the replacement refs are a problem. You can see them flitting about trying to please everyone, nervously recalling their newly learned NFL-specific rules on the fly. They're under the microscope, because we built the microscope, and what else are we going to do with it?

And sure, it's important to have competent refs. But these ones will be fine if we give them a little breathing room. They don't appear to be going anywhere anytime soon. Roger Goodell's negotiating tactics are like Kim Jong-il's. So is his ego. He'll keep squeezing the refs until they fit in his pocket, and the Goodell-ization of the NFL will be complete. Then he can get to work on his uranium-enrichment facility.

In the meantime, the refs are so busy nervously making sure they cross every I and dot every T?or, shit, is it the other way around??that they're opening the door for crafty players to manipulate the rules in their favor. Here are some of the main areas where NFL players can exploit the opportunity:

Holding: The NFL is a holding league. Everyone holds. How do you think you stop a snarling beast from going where he wants to go? You use good technique and swivel your hips and stay square and ... bullshit. Either you put the crown of your helmet under his chin, which is now illegal, or you grab him and you hold him. Ideally, it's both. It's the way you hold that determines whether or not you catch a flag.

Here's the general technique. When you engage a man on a block, you shoot your head, shoulders, and hands into his general torso area. Your head and shoulders supply the pop that you hope stuns him, but your hands supply the control. The shoulder pads come down just inside the armpits and cover the chest. That?s the best place to fit your hands, with your fingers literally underneath the pads. But that bull?s-eye is a rarity. Most of the time you shoot your hands and grab whatever you can?pads, jersey, neck hair?and pull him toward you.

But you have to keep your feet moving. Refs overlook the grabbing as long as you stay squarely in front of your man. If he breaks away from your positioning, you have to let him go, or a flag is coming. Usually. But in last week's games, blockers were given leeway to hold on longer.

Another effective form of holding is to shoot the hands and grab the outside of the shoulder pads, just over the deltoids. Totally illegal, but tolerated to a point. This is a tactic used on the edge of a run play, when you're working against a defender who's trying to contain the play or to chase a running back who's bouncing outside. Your man doesn't want to go through you; he wants to run away from you. A strong hand on his shoulder will keep him from doing it.

This is also a great technique for punt returns. You come off the ball hard, as if you're rushing the punt, your man lowers his weight to take on your rush, you engage him with an initial pop?then grab and hold on. Sometimes the ref yells "Let him go!" and you do, or else the flag is thrown. Or after the play, they'll tell you to cut it out next time. They don't want to call a penalty on every return, so they let you know when they think you're pushing it.

But the replacement refs are too concerned about enforcing the rulebook to issue any unofficial warnings. It's the Wild West on returns. Holding, blocking in the back, biting?they're letting it all ride, which is great. That means more big punt returns. Who doesn't love that?

Pass interference: In the battle between receiver and cornerback, the ref sets the terms, and precedent is established early. Corners like to get grabby. Receivers like to get pushy. And with a team of refs struggling to keep track of how many timeouts are left and thinking about whether or not to call a touchdown a touchdown when they know it's not a touchdown, and repeating the mantra "Stay off the head" all game, there's room for more extracurriculars downfield.

When the ball is in the air, the receiver has the advantage. Pushing off is an art form, and when done well, creates the right amount of separation at the right time, turning good coverage into bad coverage with a flick of the wrist. And that?s all it is?a flick.

If you put a hand on his chest and push, even a scabby ref might reach for his cloth. But a push with the back of the hand off the hip or lower torso area, or the use of a "flipper," like on a dolphin, arm tucked in and using the elbow-flip to create the separation, often goes undetected. And with these guys, it always goes undetected. That means more catches! More statistics! Yay, fantasy football!

General tomfoolery: Football is a wild-man?s game. Emotions run high. People get excited, talk shit, scream obscenities, get in each other?s faces, and celebrate like lunatics when they do something awesome. That shouldn?t be tamped down and suppressed. That should be celebrated and embraced.

Fuck that act-like-you've-been-there stuff. This isn't a sacred institution. Act like you?ve never been there before and you?ll never be there again. Act like you're out of your mind, because you are. The energy on an NFL football field does not promote levelheadedness or rational contemplation. It promotes frothing and grunting and pushing the Nitro button all the way down. I say embrace it. Don?t put a lid on it.

Here is where the replacement refs are genuinely improving the game. Regular officials have enough attention left over to enforce the NFL's incredibly uptight rules about player conduct. The replacements are desperately focused on things that really matter, like down and distance. So they are allowing players to celebrate more, yell more, and get up in each other?s faces more?knowing that it's harmless, it's natural, and that it will pass almost immediately. It's healthy communication, that's all.

Otherwise players are forced to bottle it up, and who knows when it'll get to come out again? Maybe when you walk up to one at the bar around closing time and tell him "You?re not as big as I thought you?d be." Football is a game, and game day is the players' chance to have fun. Let them enjoy themselves while it lasts. For the fan, there's always the next game. For the player, it's always almost over.
